Terms of Service

If you do not agree with any of these terms, do not access or otherwise use the Web Site, or services offered, or any information or materials contained on the Web Site. Your use of the Web Site shall be deemed to be your agreement to abide by each of the terms set forth below.

Geek Next Door® Service Contract
All references such as Customer, You, or Your refer to the person, business representative, or customer requesting services by Geek Next Door® .

ACCESS OF INFORMATION: You agree that Geek Next Door® technicians may access files, folders, programs, and potentially sensitive or personally identifiable information and/or data on my system during the requested repair service (i.e. Data Recovery, File Transfer, System Upgrades, etc). Geek Next Door will take every reasonable precaution to safeguard your personal information.

WARRANTY OF SERVICE: For hardware repairs Geek Next Door® will use new or refurbished replacement parts and components that perform to factory operational specifications. For no additional charge, Geek Next Door® will correct any defects in workmanship of the services provided the defects are reported to Geek Next Door® within 14 days from the date as posted on the provided receipt and are the cause of Geek Next Door ®. Mal-Ware, Ad-Ware, and virus removals are not included in a 14 warranty and will expire upon the departure of the service representative. Customers who have had Mal-Ware, Ad-Ware, or virus removal services are encouraged to inspect their systems before the departure of the service representative to ensure completion of service. Geek Next Door® can not ensure that infection does not reoccur due to customer use.

NOTIFICATION: When service or repair of my product is completed, Geek Next Door® will attempt to notify me of service completion. If after 30 days the customer is not able to be contacted and/or fails to respond; Geek Next Door® has the right to dispose of the serviced product by any means and methods it may choose. Also, unless otherwise made known by the customer, Geek Next Door® will dispose of any replacement products or extra parts by any means or method it may choose at its sole discretion.

SERVICE ESTIMATES: You understand that Geek Next Door® will notify me for approval of all repairs that will exceed the estimated amount stated on the service order before my product is repaired. If Geek Next Door® is unable to receive my approval to exceed the estimate, the product will be returned to the customer possibly un-repaired with labor charges still applicable.

SCHEDULED SERVICES: Geek Next Door® strives to meet the scheduled completion time, however, Geek Next Door® may change that date and will notify the customer of any significant changes to the scheduled completion time.

PRE-EXISTING CONDITIONS: In some instances Geek Next Door® may not be able to perform repairs or services due to conditions, pre-existing the repair or service of your product. Such conditions may be such as defects or failure in any software, data, or computer hardware components, or due to other factors beyond Geek Next Door’s control. In the event that repairs or services cannot be performed, Geek Next Door® will contact you. A minimum service charge may still apply in the event that services can not be completed due to the before mentioned factors. 

DATA BACKUP: Geek Next Door® will NOT back up any data, software, programs, information and/or files on customer computer (s) or devices unless I specifically request Geek Next Door® to do so. It is your responsibility to back up all software and data that is stored on your computer and/ or on any storage devices you may have prior to the arrival of the Geek Next Door® agent. Geek Next Door® shall not be responsible at any time for any loss, alteration, disclosure, or corruption of any software, data or files.

CATASTROPHIC FAILURE: In the unlikely event that a major hardware/ system failure occurs during or after the repair or service of your product and it is determined by Geek Next Door technicians that the hardware/ system failure was due to a pre-existing condition such as age, faulty wiring, dust/ dirt, power issues, heating/ cooling, or any other issue which may affect your systems integrity prior, during, or after the repair of your system then you agree Geek Next Door can not be held liable or responsible under any circumstances for loss of data, or replacement/ compensation for the damaged hardware or system.

PIRACY POLICY: It is the customers responsibility to present all necessary Operating System Software/ Restoration Media and other software related items (CD’s, DVD’s, etc) to the technician if required. Geek Next Door® will not attempt to transfer or reinstall licensed or copyrighted software without the valid media and legitimate activation keys. Pirated software will not be installed by Geek Next Door® under any circumstances.

MINIMUM LABOR: You agree to a minimum labor charge for troubleshooting/ servicing my product in the event that such labor charges are not covered by a service warranty.   A minimum labor charge may be dismissed depending on the discretion of the service representative. Failure to pay for services rendered and materials at the time of completion will result in a claims process involving city, county, and or state legal authorities and claims services with the customer incurring all costs, fines, and service charges as required for Geek Next Door® to receive payment for services rendered and materials. You agree and understand that a processing fee of $45.00 will be added to the total due for returned checks due to insufficient funds.

COLLECTION OF DATA: For verification, payment, and support purposes your name, address, credit card and other information may be recorded by Geek Next Door®  Your information will be held in the strictest confidentiality and will not be disclosed to any third party unless required by law. 

LIMITATION OF REMEDY: Under no circumstances shall Geek Next Door® be liable to you or any other person for any damages, including without limitation, any indirect, incidental, special or consequential damages, expenses costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of, or related to, the services provided by Geek Next Door® or out of the installation, de-installation, use of, or inability to use your computer equipment, hardware, peripherals, or the network resulting from services provided hereunder.

RELEASE OF LIABILITY: By signing the form on the opposite side of this page, you affirmatively release and hold harmless Geek Next Door® from and against any loss, liability, or damage that you or the owner or lessee may suffer, including but not limited to any loss of any data and the non-functioning of any component or element of your computer equipment or peripherals resulting from Geek Next Door® and/ or its third party service provider’s agents, partners and/ or third party service providers, regardless of the warranties, disclaimers and waivers.
